Monthly Membership: Charged on the 1st of each month.
Annual Membership: Charged on the 1st of the renewal month each year.
Continuous Membership Plan: Membership is part of a continuous membership plan that will remain in effect indefinitely unless termination is initiated.
Cancellation Policy: To cancel or change membership status, please provide written notice via email to membership@newportpickleball.com at least 7 days before the first of the month for which you wish to upgrade or cancel.
Payment Failures: If payment is declined for any reason, membership will become invalid until an updated payment information with an active card is registered.
Membership Holds: We do not place memberships on hold.
Program Participation: If enrolled in a program, membership cannot terminate until the program has ended. If you choose to terminate, you will be charged the difference between the member and non-member program rate, allowable once. If you choose to rejoin after cancellation, you will be charged an initiation fee.
Membership Reinstatement: If you cancel your membership and wish to reinstate after more than 30 days, an initiation fee will be charged.
Membership Adjustments: Newport Pickleball Club may, at its discretion, adjust the membership rates. You will receive at least 60 days notice of any such changes before they take effect.
Court Reservations & Fees: When booking a court, you are responsible for the court fees.
If booking for other members: those members will receive a confirmation email with a link to pay their portion of the fees. If they fail to submit payment by the time of reservation, the card of the booking member will be charged.
If booking for non-members who have a non-member account, those non-members will receive a confirmation email with a link to pay their portion of the fees. If they fail to submit payment by the time of reservation, the card of the booking member will be charged.
If booking for non-members who do not have a non-member account, the card of the booking member will be charged for that player’s non-member court fee at the time of reservation..

Court Cancellations: Court reservations must be canceled at least 24 hours in advance to avoid full court fee charges.
By voluntarily submitting your information to Newport Pickleball Club, you, the Member, Non-member or Guest, acknowledge that you have read, understand, and agree to these Policies and Rules when you are on the premises of Newport Pickleball Club. You are expected to review, and must comply with, these Policies and Rules at all times. If you violate any of these Policies and Rules, your membership, access, and/or event participation may be suspended or terminated.
Proper Conduct: We strive to uphold a fun, social, safe, and family-oriented environment, and always expect proper and respectful conduct on our premises. All players must conduct themselves in a manner that exhibits good sportsmanship. We do not permit disrespectful conduct toward others, including but not limited to—vulgar, profane, indecent, offensive, violent, hostile, aggressive, threatening, harassing, stalking, or other inappropriate conduct or communications. Anyone who commits such behavior will be asked to immediately stop such behavior and/or leave the premises at the discretion of Newport Pickleball Club.
Illness, Sickness, Disease, or Infection If you have any symptoms associated with, or you may have been exposed to a person with a communicable, contagious or otherwise transferrable or transmissible illness, sickness, disease, or infection, or you otherwise pose a health risk to others, on account of such status, you may not engage in, and will immediately remove yourself from, Newport Pickleball Club’s premises and services.
Proper Attire Non-marking court shoes are required. Athletic wear is recommended. Shirts are required to be worn at all times.
Food You may NOT bring any food, gum, candy or drinks onto the pickleball courts—with the sole exception of water or sports drinks. You are welcome to eat and drink in the alleyways directly outside the court fencing. Outside food is not allowed. The restaurant and bar offer a variety of options for purchase.
Cell Phones and Other Mobile Devices Cellular phones and other mobile devices may not be used in photographic or video mode in any rest room. Please use common courtesy when using mobile devices in other areas of the facility.
Injuries If you are injured while on the premises, please seek immediate assistance from a Newport Pickleball Club staff member, who can provide or arrange for appropriate medical assistance and complete an incident report. Newport Pickleball Club is not responsible for, nor will be liable for reimbursement of medical costs, including, but not limited to charges a member or guest may incur for emergency response services, ambulance, etc., in the case of a medical event or emergency that occurs in our facility, or, at our events.
Liability Waiver:
All members and guests must sign a waiver upon joining or visiting.
Photography and Video Professional photography on the premises is not allowed without the advance written approval of Newport Pickleball Club. Personal photography is only allowed in public areas of the facility. No photography or cameras of any kind are allowed in any locker room or restroom. By your continued use of Newport Pickleball Club’s premises and services, including participation on the courts, you irrevocably consent to and grant Newport Pickleball Club the exclusive, worldwide, perpetual, royalty free and otherwise unlimited right to use, copy, modify, distribute, publicly display and perform, publish, transmit, remove, retain, and repurpose the images for any purpose in any media or form of communication, without additional consent and without compensation, including but not limited to Newport Pickleball Club commercial and promotional use on its social media sites.
Newport Pickleball Club’s Wireless Network By accessing Newport Pickleball Club’s wireless network, you agree not to use the wireless network to transmit any material that violates any applicable laws, rules or regulations or to defame, harm or threaten or attempt to harm other persons, businesses or other entities. You also agree not to use our wireless network to transmit any material that infringes any copyright, trademark, patent, trade secret or other proprietary rights of Newport Pickleball Club or any third party. You agree not to violate the security or integrity of our wireless network or to use our network to violate the security or integrity of any other network. Any such acts may result in the termination of your membership and your ability to access our premises as well as criminal and civil liabilities. Use of this wireless connection is entirely at your risk and Newport Pickleball Club disclaims all liability for loss of confidential information or damages resulting from that loss. We make no promises, representations or warranties of any kind concerning the suitability or security of this service and specifically disclaim all warranties of fitness for a particular purpose of security. The wireless service is provided “As Is.” You will remain connected to the Newport Pickleball Club wireless network until you disconnect. By using the wireless service, you agree to indemnify Newport Pickleball Club, its officers, employees and agents against all claims, demands, losses, damages, costs and expenses made against or incurred, suffered or sustained arising out of your use of the wireless service and agree that in no event will we be liable for any damages, including but not limited to any direct, indirect, incidental, special or consequential damages arising out of or in connection with your use of, or inability to use, the wireless service. We may block access or terminate the wireless service at any time and for any reason and assume no liability for doing so. We may record information about your usage of our network and may use or disclose such information, when appropriate, to comply with the law or to protect the rights, property, or safety of Newport Pickleball Club.
No Weapons You may not bring, or use, weapons of any kind on the premises of Newport Pickleball Club for any reason.
No Drugs You may not use, smell of, possess, or sell any illegal drug on the premises. You may not use our courts, services or programs while under the influence of illegal drugs. You should not use, or should stop using, any court, service or program if your prescription medication adversely impacts or influences your ability to safely use our courts or participate in our programming.
No Smoking You may not smoke, chew or use any tobacco, marijuana, or electronic cigarette products on Newport Pickleball Club’s premises including any outdoor areas (e.g., sidewalks or parking lot), or at Newport Pickleball Club events.
Alcohol You must be of legal drinking age and have valid identification to consume alcohol on the premises of Newport Pickleball Club. Alcohol must be consumed responsibly, and you assume all risks associated with your consumption of alcohol. Excessive consumption of alcohol while on our premises will result in your immediate removal from our premises, and may result in the termination of all Newport Pickleball Club privileges without a refund of any kind.
Facility Closure or Access Restrictions We reserve the right to close or restrict access, without advance notice, to any area of, or the entire premises of Newport Pickleball Club, for any reason, including but not limited to closures or restrictions related to construction, remodeling, repair, or maintenance (whether planned or unplanned) or for health or safety reasons, including but not limited to weather, natural disasters, power outages, and medical issues. Updates on any such closures can be found on our website.
Property Damage, Theft, Loss, etc. Newport Pickleball Club and its employees and agents shall not be liable for any damage to property of its members or guests by theft or otherwise.
Animals You may not bring any animal on the premises unless it is a service animal performing its duties in the care of a person who requires its assistance or is an on-duty law enforcement animal (“exempt animals”). All exempt animals must be licensed, vaccinated and have identification tags (where applicable); must remain leashed or caged, and under a responsible person’s control at all times; and must be removed immediately if it causes a disturbance, interrupts others or poses a health or safety risk to those who are exposed to it. The animal’s owner must promptly remove animal waste and is liable for any damage caused by the animal.
Damage to Newport Pickleball Club facility You may not damage the Newport Pickleball Club facility in any way, including but not limited to any damage to, or theft of, supplies, or other facility property. If you or your child/ward damages the center, you are liable and must pay for the damage caused, and your Newport Pickleball Club privileges may be terminated.
Court Reservations You must reserve pickleball courts in advance via our website or through our App. You may call the front desk for a reservation. Walk-ins are welcome pending court availability. All courts are deemed equal. Patrons may reserve and/or request specific court numbers, but with no guarantee. Court assignments are subject to change as Newport Pickleball Club deems necessary.
Gift Cards are non-refundable.
Cancellation Policy All cancellations must be made at least 24 hours in advance by going to our website or App. We will not credit your account for any reason unless cancelled at least 24 hours in advance. There are no make-ups for missed clinics or sessions. Newport Pickleball Club reserves the right to cancel a class or clinic due to insufficient registration prior to the first class of the session.
Borrowing Paddles and Balls Newport Pickleball Club will make available paddles free of charge for the duration of your court reservation, pending availability. Demo paddles are available for $10.00 per paddle, based on availability. The player must leave their license, keys or phone, which will be returned when the loaned paddle is given back in no worse condition other than ordinary wear and tear. Balls are available at the court.
Music Music may only be played by Newport Pickleball Club. The use of, and choice of, music played by Newport Pickleball Club is at the sole discretion of the Newport Pickleball Club staff and employees.
Complaints and Protests All complaints must be made in writing addressed to the General Manager (GM) and signed by the person making the complaint. The GM shall review all complaints and protests, and will make a decision, which shall be final and binding to everyone concerned.
Disciplinary Procedures Should the conduct of any member, guest, or visitor give concern to a Newport Pickleball Club staff member, either by observation or by intimation, Newport Pickleball Club may take whatever action it deems to rectify the situation in terms of suspension or expulsion from Newport Pickleball Club, without the return of any monies already paid to Newport Pickleball Club. The decision of management shall be final and Newport Pickleball shall not be liable for any such decision.
RELEASE, ASSUMPTION OF RISK, PERMISSION AND INDEMNITY AGREEMENT IMPORTANT: THIS IS A LEGAL DOCUMENT FOR THE Newport Pickleball Club, INC. AND ITS AFFILIATES AND SUBSIDIARIES (COLLECTIVELY, “Newport Pickleball Club”). PLEASE
READ CAREFULLY AND UNDERSTAND THIS DOCUMENT BEFORE SIGNING THIS RELEASE, ASSUMPTION OF RISK, PERMISSION AND INDEMNITY AGREEMENT. THIS IS A BINDING LEGAL AGREEMENT AND BY SIGNING IT YOU ARE WAIVING CERTAIN LEGAL RIGHT WAIVER AND RELEASE OF LIABILITY. In consideration of permission to use, today and on all future dates, Newport Pickleball Club’s facilities, premises, and equipment, I (the facility user, participant, or member), for myself, my heirs, personal representatives or assigns, and/or child(ren)/ward(s), do hereby waive, release, discharge, and covenant not to sue Newport Pickleball Club, its directors, officers, employees, affiliates, subsidiaries and agents from liability from any and all claims including negligence of Newport Pickleball Club resulting in
personal injury, accidents, illness, death, and/or property loss arising from, but not limited to, individual use and/or participation in activities, events, classes, clinics, tournaments, league play, observation, and use of facilities, premises, or equipment at a Newport Pickleball Club facility or Newport Pickleball Club organized event.
ASSUMPTION OF RISKS.
I understand that although Newport Pickleball Club has taken reasonable steps to provide me with appropriate facilities and/or equipment to undertake the activities specific to the facilities and premises of Newport Pickleball Club, there are certain risks that are inherent that may not, or cannot, be completely eliminated. I understand that the facilities and activities offered by and through Newport Pickleball Club may be physically demanding, dangerous, and involve risks of illness, injury, and/or death. I hereby assert that my participation in the activities at, and usage of, Newport Pickleball Club’s facilities is voluntary and that I knowingly assume all such risks for myself and on behalf of my child/ward. I understand that injuries or damages may include, but are not limited to (a) major or minor personal, physical, bodily, emotional, mental, economic, property, or other types of injuries or damages (“injuries”) to me, minor(s), or guest(s); (b) death, paralysis, brain damage, heart attacks, strokes, disfigurement, heat stress and/or heat stroke, dehydration, concussions, hearing loss, torn or damaged muscles or ligaments/tendons, joint problems or injuries, broken bones, allergic reactions, burns, sprains, bruises, and/or scrapes; (c) aggravation of pre-existing injuries or medical conditions; (d) pain and suffering; (e) loss of consortium, love, affection, comfort, companionship, or care; (f)- emotional distress, embarrassment, humiliation, or shock; (g) lost wages or lost earning capacity; (h) lost, stolen, misused, or damaged property or information; and (i) any other disability, impairment, incapacity, injury, or damage.
INSURANCE, MEDICAL TREATMENT, AND PREEXISTING MEDICAL CONDITIONS.
I have adequate health insurance or funds to cover the costs of treatment in the event of an injury and I agree to be personally responsible for all costs of any emergency or other medical care that I may suffer while engaging in activities at Newport Pickleball Club’s facilities and/or premises. I also agree to indemnify, release, waive, and hold harmless Newport Pickleball Club (and any of its officers, directors, employees, agents and affiliates) from the cost of any medical care that I receive as a result of participation in activities at Newport Pickleball Club’s facilities or premises, whether requested by me or Newport Pickleball Club. I represent that I am in good physical condition and free from known heart, respiratory, or other health problems that could limit or prevent me from safely participating in activities at Newport Pickleball Club’s facilities, premises.
USE PERMISSION AND RELEASE.
I hereby give Newport Pickleball Club and its agents, affiliates and designee’s permission to use or distribute, without limitation or obligation, my image, name, voice, and words for any purpose connected with Newport Pickleball Club, including promotional, marketing, training, informational, and archival uses. I understand and agree that all photos and other materials will become the property of Newport Pickleball Club and will not be returned. I hereby irrevocably authorize Newport Pickleball Club to edit, alter, copy, exhibit, publish, or distribute these photos and materials for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo, image, name, voice or words. I hereby hold harmless, release, and forever discharge Newport Pickleball Club from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
INDEMNIFICATION AND HOLD HARMLESS.
I agree to indemnify, defend, and hold harmless Newport Pickleball Club, its directors, officers, employees, agents, and affiliates from and against any and all complaints, charges, claims, damages, losses, costs, liabilities, and expenses (including attorney fees—see below) due to, arising out of, or related in any way to my participation in activities at or use of equipment of the facilities or premises of Newport Pickleball Club. I (the facility user, participant, or member) agree to pay any and all attorney fees and/or costs incurred by Newport Pickleball Club in enforcing this Agreement. I agree to defend, indemnify, and hold Newport Pickleball Club harmless to the fullest extent permitted by law from and against any claim (including any negligence claim) asserted against Newport Pickleball Club by any other person (including facility user, participant, member, guest, family member, or any other person or entity) arising out of, resulting from, or caused by the use of Newport Pickleball Club premises and/or services by me, minor(s), member(s), or guest(s). I agree that to defend Newport Pickleball Club means that I will pay any settlement, judgment, or other damages, fees, or costs of any type incurred by Newport Pickleball Club to resolve the claim. SEVERABILITY. If any portion of this Agreement is held to be invalid by a court of law, then it is agreed and intended that all the remaining provisions of the Agreement shall, notwithstanding, continue in full force and effect. CONSENT TO ARBITRATION. I (the facility user, participant, or member) agree to arbitrate all disputes arising from this Agreement. Arbitration prevents me from suing in court and having a jury trial. I also agree that any arbitration will occur in the state of Utah, in a venue chosen by a representative of Newport Pickleball Club, and will be conducted confidentially by a single arbitrator in accordance with the rules of the American Arbitration Association. COVID-19 IMMUNITY. I understand that Newport Pickleball Club is immune from civil liability for damages or an injury resulting from exposure of an individual to COVID-19 on the premises owned by Newport Pickleball Club
OTHER.
I understand that I must use proper clothing and equipment in activities related to, or made available through usage of Newport Pickleball Club’s facilities, premises, and equipment. I take personal 2 responsibility for myself and/or my child(ren)/ ward(s) to ensure properly fitting clothing, footwear, hydration, alimentation, and equipment used in my use of Newport Pickleball Club’s facilities, premises, and equipment. MINOR RELEASE (if applicable). I, the minor facility user’s/participant’s/ member’s parent and/or legal guardian, understand the nature of the activities offered by and at Newport Pickleball Club’s facilities, along with the minor facility user’s/participant’s/member’s experience and capabilities, and I believe the minor to be qualified, in good health, and in proper physical condition to participate in such activities. I hereby release, discharge, covenant not to sue, and agree to indemnify and hold harmless Newport Pickleball Club from all liability, claims, demands, losses, or damages on the minor facility user’s/participant’s/member’s account, caused or alleged to be caused in whole or in part by the negligence of Newport Pickleball Club or otherwise, including negligent rescue operations and further agree that if despite this release, I, the minor facility user/participant/member, or anyone on the minor facility user’s/ participant’s/member’s behalf makes a claim against Newport Pickleball Club or any of its agents, I will indemnify and hold harmless Newport Pickleball Club from any litigation expenses, attorney fees, loss liability, damage, or cost any may incur as the result of any such claim. ACKNOWLEDGMENT OF UNDERSTANDING. I, THE PARTICIPANT OR PARENT/ GUARDIAN OF THE PARTICIPANT HAVE CAREFULLY READ ALL OF THESE A G R E E M E N T T E R M S A N D F U L LY UNDERSTAND THEIR CONTENT AND AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN THE Newport Pickleball Club AND ME, THE PARTICIPANT OR PA R E N T / G U A R D I A N O F T H E PARTICIPANT. I AM OF A SOUND MIND AND AM NOT SUFFERING FROM SHOCK OR UNDER THE INFLUENCE OF ALCOHOL, DRUGS, OR INTOXICANTS THAT AFFECT MY ABILITY TO READ AND UNDERSTAND THIS DOCUMENT. I HAVE BEEN GIVEN AN OPPORTUNITY TO DISCUSS THIS DOCUMENT AND ITS CONTENTS WITH MY LEGAL COUNSEL BEFORE SIGNING. I AGREE TO AND SIGN THIS AGREEMENT FREELY AND VOLUNTARILY BY MY OWN FREE WILL, WITHOUT DURESS, AND A S S E R T T H A T N O O R A L REPRESENTATIONS APART FROM THIS AGREEMENT HAVE BEEN MADE. Additionally, I acknowledge that I agree that I am responsible and expected to always review and comply with Newport Pickleball Club’s policies and rules.
